FOR IMMEDIATE RELEASE – November 16, 2021
MAN CHARGED WITH ASSAULTING A MOUNT VERNON POLICE OFFICER.
White Plains, NY -- Westchester County District Attorney Miriam E. Rocah announced that Mount Vernon resident Kevin Heron was charged with assaulting a Mount Vernon Police Officer who was trying to place him under arrest.
Heron, 27, was charged on November 12, 2021, in Mount Vernon City Court with Assault in the Second Degree, a felony.
According to the felony complaint, on November 10, 2021, at approximately 1:40 p.m., Heron, in an attempt to evade arrest on an outstanding warrant, attacked Officer Michael Hutchins at a restaurant on Gramatan Avenue in Mount Vernon. The attack caused Officer Hutchins to fall, and while on the ground, the defendant punched Officer Hutchins repeatedly in the face and bit his finger, causing his fingernail to fall off. With the assistance of a bystander, Officer Hutchins attempted to gain control of the defendant, who attempted to reach for his service weapon and continued to fight, punch and resist arrest, even as Officer Hutchins and other members of the Mount Vernon Police Department arrested him. Officer Hutchins was transported to the hospital, where he was treated for his injuries.
The case is being prosecuted by the Mount Vernon Branch of the Westchester County District Attorney’s Office. Heron is scheduled to appear again in Mount Vernon City Court on December 7, 2021.
The charges against the defendant are merely an accusation, and the defendant is presumed innocent unless and until proven guilty.
