PUBLIC HEARING WED to allow Sam’s Club to add fuel station.

On Wednesday, November 10th, 2021 at 7:30pm, the Town Board has scheduled a public hearing associated with a petition by Sam’s Club (333 Saw Mill River Road) for an amendment to the Zoning Ordinance to allow fueling stations by special permit, in the DS Designed Shopping District. This matter was the subject of public hearings previously held by the Board in 2020.  Some gas station owners who have stations near Sam’s Club objected. At the conclusion of a hearing in 2020, the Town Board asked the Applicant to conduct additional outreach to residents, customers and local businesses, including potential competitors. The Applicant recently appeared before the Town Board at a work session with updates. 

Representatives of Sam’s Club highlighted the importance of adding fueling stations to its Saw Mill River Road location in the Town of Greenburgh to best ensure its long-term viability in the Town. FRIENDLY REMINDER- TREE LAW NEEDS TO BE COMPLIED WITH.

As you may already know, the Town has a new tree ordinance which went into effect on January 4, 2021, where all properties are required to obtain a permit prior to removing trees larger than 8 inches in diameter at breast height (DBH). For trees growing on steep slopes and in regulated wetland areas, the sizes that require a tree removal permit are 6 inches and 4 inches DBH, respectively.

We understand there still may be some confusion about the new tree law. We often hear that a resident inquired a while ago with the Town – before the new law took effect – and got the answer that no permit was required. That information is no longer correct. You do need a tree removal permit if your tree exceeds the minimum size listed above. Town staff are available to answer your questions.

Please also note that some tree services and landscape companies still do not know about this law, even though Town sent out notifications. Please ask your tree service company and/or landscaper about their knowledge of the new law. We do know that there are companies out there who assist their clients in completing the application process.
