SENATOR BIAGGI AND ADVOCATES HOLD PRESS CONFERENCE CALLING FOR LEGISLATION TO CLOSE VOLUNTARY INTOXICATION LOOPHOLE.
ALBANY, NY – Today, bill sponsor State Senator Alessandra Biaggi will join Safe Horizon, Community for a Cause, National Organization for Women NY, survivors, and legislators to call for the Senate and Assembly to pass legislation to close the voluntary intoxication loophole.
Current law treats victims of sex crimes differently in cases where the victim voluntarily consumed alcohol or drugs to the point of intoxication versus a victim who became involuntary intoxicated due to the actions of someone else. The penal law, in its definition of mental incapacitation, only recognizes cases where a substance is administered involuntarily, like being roofied. S452A/A5519A updates the penal code to protect all survivors of rape regardless of how they became intoxicaed.
